Emergency ordinance no. 89/2023 for the amendment and completion of the Government Emergency Ordinance no. 67/2023 regarding the establishment of a temporary measure to combat excessive price increases for some agricultural and food products was published in the Official Gazette, Part I no. 978 of October 27th, 2023.
The measures in this emergency ordinance apply until January 31st, 2024!
The main changes/additions to the Government Emergency Ordinance no. 67/2023 regarding the establishment of a temporary measure to combat excessive price increases for some agricultural and food products:
- For agricultural and food products that enter the territory of Romania and are not included in the processing/slaughtering process, the commercial surcharge rate is a maximum of 5% compared to the purchase price, to which direct and indirect expenses are added. The agricultural and food products that are subject to this measure are: oil, sugar, flour, cornmeal, pork, chicken, beef, for quantities of packaged product greater than 5 kg, respectively 5 l.
- During the period of application of this emergency ordinance, the re-invoicing of agricultural and food products from the annex, as well as the services related to their delivery and marketing, is prohibited. Failure to comply with this provision constitutes a contravention, if it was not committed under such conditions that, according to the criminal law, constitutes a crime, and is sanctioned with a fine from 100,000 lei to 2,000,000 lei. The finding of the contravention and the application of the sanction are carried out by the ascertaining agents within the National Agency for Fiscal Administration, through the competent control bodies of the subordinate structures, or by the Competition Council, according to the competences.
- Units issuing meal, gift and social vouchers, including those issued through the Support for Romania Program, regardless of the way in which the vouchers are issued, in electronic format or on paper, and their type, may apply to merchants at the time of their settlement a commission of a maximum of 2% for all agricultural and food products that can be purchased with them, without being limited to the products provided in the annex to this emergency ordinance.
- The list of products for which trade mark-ups are limited (maximum 20% at the manufacturer, 5% accumulated throughout the distribution chain, 20% at retailers) has been completed: 1. Plain white bread weighing between 300 and 500 grams, without specialties. 2. Cow's milk for consumption 1 l, fat 1.5%, except for UHT. 3. Telemea bulk cow cheese. 4. Plain yogurt from cow's milk, 3.5% fat, with a maximum weight of 200 grams. 5. White wheat flour "000" up to 1 kg. 6. Corn meal up to 1 kg. 7. Chicken eggs caliber M. 8. Sunflower oil up to 2 l. 9. Fresh chicken meat*). 10. Fresh pork meat**). 11. Fresh vegetables in bulk***). 12. Fresh fruit in bulk****). 13. Fresh white potatoes in bulk. 14. Cast white sugar up to 1 kg. 15. Rice - round grain - weighing between 0.5 and 1.5 kg. 16. Cozonac. 17. Tomato broth. 18. Cream - 12% fat. 19. Margarine. 20. Yeast. 21. Minced meat.
