GEO 93/2023: Revision of the minimum wage in the construction, agricultural and food industry sectors

Emergency ordinance no. 93/2023 for the establishment of the gross minimum basic salary per country guaranteed in payment for the construction, agricultural and food industry sectors was published in Official Gazette no. 993/01.11.2023.

The main provisions:

The minimum wage in construction

  1. For the construction sector, the gross minimum basic salary per country guaranteed in payment is set in money, without including allowances, increments and other additions, at the amount of 4,582 lei per month, for a normal work schedule of 165,333 hours per month on average , representing on average 27,714 lei/hour.
  2. The above provisions apply exclusively to the fields of activity provided for in art. 60 point 5 of Law no. 227/2015 on the Fiscal Code, with subsequent amendments and additions.
  3. Remember! Non-compliance with the minimum wage provisions by companies constitutes a contravention and is sanctioned according to the provisions of art. 260 para. (1) letter a) from Law no. 53/2003, republished, with subsequent amendments and additions, and results in the cancellation of the granting of fiscal facilities.

The minimum wage for the agricultural sector and the food industry

  1. For the agricultural sector and the food industry, the gross minimum basic salary per country guaranteed in payment will be 3,436 lei per month, not including allowances, increments and other additions, for a normal work schedule of 165,333 hours per month on average, representing on average 20,782 lei/hour.
  2. The above provisions apply exclusively to the fields of activity provided for in art. 60 point 7 of Law no. 227/2015, with subsequent amendments and additions.
  3. Non-compliance with the minimum wage provisions by companies constitutes a contravention and is sanctioned according to the provisions of art. 260 para. (1) letter a) from Law no. 53/2003, republished, with subsequent amendments and additions, and results in the cancellation of the granting of fiscal facilities.

IMPORTANT! The provisions of this emergency ordinance apply starting with the revenues related to the month of November 2023!
